A couple of days ago the trial against The Pirate Bay began in swedish court. TPB is the worlds largest torrent-tracker, and is charged with soliciting and preparing for crimes against copyright. On the other side are representatives for the international movie and music industries and other parties. There is a lot of media coverage of this event, which is made even more interesting by the fact that the accused take a kind of moral stance, saying that (besides not having violated any law), they are morally in the right, that they a realizing a kind of ideology that is opposed to intellectual property as a concept.

Among other things, this has made me realize that I am a behind (as well as parts of the traditional media) in the modern blog-oriented life - it's all a bit confusing.

I´m expecting the guys to transfer "ownership" of Pirate Bay ( as the infrastructure is already outside of Sweden ), and they will lose the case.. but the court will be reasonably kind to them.

The first round is over. Four persons running The Pirate Bay were sentenced to one year in prison and to pay 30 million SEK (~3 million Euro) in damages. A fair amount of news coverage on this around the world.

Many have commented that they think this is an unexpectedly harsh penalty, even though they thought they were going to be found guilty. There's probably going to be two more rounds of appeal before a prejudicial verdict is found in the swedish supreme court.

Nah, all things considered this is a pretty cute and cuddly verdict. But they will be back for another round in court.

I saw a documentary quite a few years back now, about Swedish prison, being the most liberal system in the world. Is this still true, or are you swilling Gruel once more?

The jury is out for me on illegal downloading. After a few years when I had released my first LP, a friend Kath said that she was really looking forward to listening to my album, as soon as it downloaded from Hotline Exclamation. I do admit myself to using dodgy software in the past, but these days tend to prefer shareware, because my new opinion is that supporting cracked software only keeps the monopoly with the big boys- such as Adobe for eg.

Yeah, we're pretty liberal - that's why a lot of local comentators think that especially the one year in prison sentence is harsh. But we're adapting to the standards of the rest of the world.

I'm also on the fence about this. On the one hand it's sad to see technical advancements being held back by market machines, on the other hand content creators should be compensated for their efforts if they are successful enough so that people acually want to use/listen. We need to be able to work professionally with this stuff as other jobs are taken over by machinery.

Talking about stealing. Every time I burn a CD with my own work sombody els get payed. Is that fair?

Imho it's not stealing.
And what about services like Rapidshare?
They are getting paid for providing downloadable stuff.
No one gets paid for that.
I download all my stuff and if i really like it i'll buy an origional anyway.
